What really happened to GMO labeling in Washington

Monsanto and the junk food industry teamed up to shatter Washington state records. They dumped more than $22 million into fighting against GMO labeling.  Exactly $550 of the “no” campaign’s dollars came from inside Washington State.  This was a classic example of out-of-state corporate interests pouring massive money into maintaining control of our food systems.

And based on returns so far, it looks like a campaign full of misleading ads and laundered money may have done the trick.

There are still hundreds of thousands of votes to be counted, and it will be several days before we have the final results. But with over half of the ballots counted, the “no” side was winning with over 54% of the vote.

522_no pattern in Washington has been very similar to what happened to California’s proposition 37 a year ago.  Early polling found the initiative way ahead – consistent with national polls which find that a huge majority of the American public supports labeling of GMOs.

But then the misleading ads started pouring in.

The anti-labeling ads that blanketed Washington’s air waves recycled the same themes, and even some of the same content, that had been found most effective in California. They also included some extremely dubious statements.

For example, the “no” ads told consumers that this initiative would increase food prices by an average of $350-$400 per family per year. But Consumers Union (publisher of Consumer Reports) determined that this statement was untrue, and that this initiative would not raise the price of food.

The “no” ads told Washington voters that Initiative 522 contained all sorts of exemptions and special interest loopholes. And it is true that there were exemptions in the law for restaurant and medical foods. But these exemptions, far from being special interest loopholes, are consistent with generally recognized labeling standards practiced nationally and globally. Are we really supposed to believe that the “no” campaign thought the trouble with I-522 was that it was not strict enough?

The largest single donor to the “no” campaign, the Grocery Manufacturers Association (GMA), is currently facing a money laundering lawsuit from the state Attorney General. They channeled more than $11 million into this effort, and tried to hide their actual donors from the public. It would appear that companies like Coke and Pepsi wanted to keep us all in the dark, but did not want to face a consumer backlash so they tried to use the GMA as a cover.

The attorney general’s lawsuit generated some degree of disclosure, but the damage from millions of dollars in outside spending of laundered money had been done, and the legal proceedings, which seek punitive damages, will not be complete until months after the election is long finished.

What the GMA’s shenanigans tell us is that a growing body of companies fear consumer backlash if they oppose GMO labeling. Monsanto may not care, since they don’t sell direct to the consumer anyways. But with a lot of “natural” brands like Odwalla, Kashi, and Naked Juice owned by companies like Coke, Kellogg, and Pepsi, there is a growing fear that boycotts could hit their bottom line.

The non-GMO certified food sector has grown from nothing to $3.5 billion in sales in just the last three years. Whole Foods has reported a sales bump of 15% to 30% when products are certified non-GMO.

Consumer pressure, then, may be able to accomplish what ballot initiatives have not yet achieved. If non-GMO products can establish a stronger footing in the marketplace, and if companies (including “natural” brands) face boycotts when they or their parent corporations attempt to keep consumers in the dark, then the tide could turn very quickly.

Labeling initiatives are underway in at least 20 more states. Monsanto and the junk food industry may have managed to keep Washington voters in the dark a little longer. But it is going to be hard keep convincing the American people that we don’t want to know how our food was produced. 

“Win or lose, this is a long war,” said David Bronner, CEO of Dr. Bronner’s Magic Soaps, the initiative’s biggest donor. “Labeling is inevitable.”

    I am just disgusted that once again these corrupt companies have spent millions of dollars to keep consumers in the dark. But I completely agree that we can win this war with our pocketbooks. If we boycott the companies that are contributing to keep us from having labels then eventually they will be forced to change their products or go out of business. This fight is not over.

    Naturally it is sad news that the propostion may be defeated. For me the issue is more complicated that corporate money swaying voters. it is my opinion that the ethics of science have been be corrupted. Where there is clear evidence of the potential for harm any any technology, especially when dealing which such a powerful technology as genetic engineering, there should be such an outcry against it that the vibration of combined voices would rattle windows around the world. It seems that the public at large are to easily persuaded by slick ads and corporate spin to fully grasp the real danger they face every time they have a meal. As always seems to be the case, the tie of opinion may only shift after enough people become ill or die as a result of some condition which can be directly attributed to GM food. It seems always to be the case that tragedy lowers the threshold of tolerance.

    Boycott Whole Foods! They could change the tide overnight if they would refuse to carry GMOs in their store. I know they have an initiative to achieve that goal, but not until 2015! And if they really cared, where was there monetary contribution to the cause?

      I used to think as you did. The problem is the long backlog at nonGMO project certification. There is an incredible number of products waiting. Their process is not a rubber stamp so there is a reason for the delay.

        Maybe I'm wrong, but it seems that you're defending Whole Foods. I don't doubt that there are lots of products awaiting non-GMO certification, but there are thousands of products already certified on the market today. And that only focuses on certified non-GMO items; why can't Whole Foods refuse products that they KNOW are GMO today, or even in 2014? That could easily be part of their transition, removing known GMO items from the shelves and adding more certified non-GMO & organic items as they become available. Further more, why haven't they contributed to the pro-labeling movement? I can guarantee they make a lot more money than I but somehow I still managed to find time and money to contribute. Look at Dr. Bronner's coming up with almost two million dollars! Just because Whole Foods carries a few organic items does not mean they're part of the solution; they're just another corporate giant that sees a way to make a buck!

          I agree with you here. But to tell you the truth, I usually shop the freshly fixed food at Whole Foods. I've never noticed if they carry FritoLay or other Pepsi products, or what kinds of cereals they carry.

          I called up Kashi to find out why some of their cereals were labeled Organic or non-GMO certified and others were not, because my favorite did not carry such a label and I was not going to buy it again if it had any GMO ingredients. They assured me that all of the grains and the soy in GoLean were non-GMO and that they were in the process of getting certified.

      What? Whole foods is not the problem. They are a supporter of labeling GMO foods and had big signs out front and had pins inside to give to people. We can't go after the stores that are trying to do their part. Not to mention, the fight right now is to LABEL our food, not take every non-GMO food out of stores.
      Do you know how many products Mansanto genetically modified corn seeds are in? I believe we need to fight this one step at a time.
      Perhaps health-minded businesses will eventually move toward only carrying non-GMO foods, but to ask that of them now when they are donating money to get labeling passed is asking too much I believe.
      The big issue is…why is America once again behind the times when it comes to health related issues? 64 other counties label their GMO foods. The same is true for pharmaceutical drugs… Europe removes many potentially dangerous pharmaceutical drugs off the market years before the USA does.
      We are money-driven country and unfortunately greed is winning.

        Sorry to bust your bubble, but Whole Foods is just another big corporation trying to make a buck…at your expense. I thought they had committed to full transparency in their US stores by 2015, but I checked and it's actually 2018! Funny, because Whole Foods in Europe already does labeling…just not in their North American stores. And they have NOT contributed one dollar towards any of the labeling efforts in various states across the US. Does that sound like a supporter to you? No, it sounds like a company that has seen the writing on the wall and wants to appear as part of the solution so their flow of money isn't affected. I understand that in parts of the country Whole Foods may be the only option for non-GMO and/or organic groceries, which is definitely better than no option at all, but that doesn't mean they're looking out for you or your health!

    This shows how removed from "Truth in Advertising" laws big corporations are (untouchable?), and how little our representatives reflects concerns of their constituents, in favor of those of their major financial supporters, you know, the 1%.

    Best is to grow your own "victory" garden, victory balcony, shop local farm stands and boycott products from companies that slush funded the NO Label position. This can be more easily accomplished now by supporting products marked with the Non-Gmo initiative.

    We as consumers vote with our purchases at the grocery store. We need to start a boycott of those products that are GMO's. If we don't buy their product they will stop selling it. These companies only care about their bottom line profits, so that is where they are most vulnerable. We need to get out more lists of those products that do contain GMO's so be can avoid purchasing them.

    I think there is something crooked going on with the voting process. I don't think people are that stupid to vote against having labels on their food. The only way to fight it now is to refuse to buy their food. Grow your own, learn to cook with basic ingredients, not mixes or processed food. Buy from local farmers. Get some chickens. Educate yourself and others.

      Lucy, I have been saying for quite awhile that as long as we have computerized voting, we can't trust the voting process. It is just to easy to make the results come out the way someone might want.

    It's time for all the NON-GMO products to label them. No big deal just a nice big sticker on the product "NON-GMO". People need to buy organic. The poisoning of our food has to stop. It will only be stopped when people stop buying it. The rest of the world requires labels or has banned GMO's. Americans wake up!

      Of course, mark the products that do not use GMO, like it was done with trans fats, remember? Everybody suddenly has trans fat on the list of ingredients marked with a content of "O" . Obviously, those that do not say NO GMO, must be GMO. So simple! Has nobody thought of that yet?

    Perhaps a better approach is to encourage labeling of products that are GMO Free! Companies that are free should be proud of that fact and that is actual awareness of gmo's as well. It will have the same outcome. Those who don't care will just continue to buy "regular" products. The rest of us will KNOW and be able to make healthy choices. I am doing this at Herbal Energetics/InJoy Organics, my small cottage industry.

      Yes, but when a mind if filled with campaign lies, it is hard to know who to believe. I watched a program in WA the Sunday before election day and they had a pro and con representative for the I-522 campaign. Although the women for YES on I-522 was well-spoken, she didn't answer some of the questions asked of her. Being 100% for labeling GMO food, I was very frustrated watching the responses.
      One question asked to the YES on I-522 spokesperson was, "what is the problem with GMO food?, is there a health risk? Why is it so important to label?" The YES on I-522 person did not answer but went back to her argument of 'transparency' and 'we have the right to know'. She said nothing about GMO foods are being found to create intestinal and gut issues, etc. That changing the DNA structure of a seed or food is not recognized by our body int the same way, etc.
      After listening the scientists speaking for the GMO summit in the previous weeks, there is MUCH to be concerned about with regard to health, but this was not conveyed to the public.
      King county has not been counted yet and it might be 2 days before it's fully counted, so I'm hoping for King county to pull us through.

      Hi, Leah – Thanks for asking! I hope you get other replies, but I'll throw out a bit of info. "GMO" stands for "genetically-modified organism(s)." This is a process for coming up with completely new plants that have genes that are foreign to them inserted. This process is different from traditional plant-breeding and hybridization. For example, an animal/insect gene might be inserted into a plant, perhaps to make it more resistant to a certain chemical fertilizer. Seeds from these genetically-modified plants are patented, so big agricultural corporations will go after any farmer trying to save seeds, too. It's becoming clearer that GMO's are a major factor in many auto-immune disorders, where the body perceives foreign organisms or substances in our bodies and starts attacking them and eventually our own bodies. Try searching for an online film called "Genetic Roulette" for more info, for the connection between many more illnesses and disorders (including in kids).

    We need to hurt these companies where it counts. In there pocket books! Because its all about the money. I think boycotts are where we need to go from hear to get this madness stopped. I would appreciate a complete list of company's that contributed to these campaigns to stop the labeling of the GMO's in Both Washington and California. So I can boycott them all, and pass the info onto all my friends, so they can do the same.

    As an interested observer living in British Columbia (northern neighbour to Washington State) I was disappointed but not surprised in the defeat of the proposition. Many people prefer to stay asleep and reject any criticism of big agra, big pharma and the telecoms as simply the chatter of raving lunatics and extremists. To believe anything negative about our big corporations, utilities and governments would force such individuals to take a stand and perhaps change their own habits. Too inconvenient!
    Rather than fight these corporations in an arena where they have most of the money; can influence the media through advertising dollars; and can buy off the politicians, we are better off to fight the battle at the consumer level. As others have pointed out, those that market non-GMO foods can and do put this on their labels. Those are the foods I buy while I assume that everything without such a label contains GMO and likely non-organic ingredients. So, in effect, we all have GMO labelling right now. If it doesn't say non-GMO on the label, just assume it contains GMO items. Now we can let the market decide. Just remember, the market is us.

      I utterly endorse your consumer tactic – it's working for me and can work for everyone. I am not going by urban legends about some brands supposedly being non-GMO but not labeled as such. Monsanto et al, despite all their organism patent claims and legal aggression for them, have demonstrated that they are ASHAMED of their GMO products and so don't want them labeled as such. By the same token vendors of NON-GMO products have every right to be PROUD of their products and to label them as such. That's after all the way the label 'organic' works. If it isn't already 'organic' I will consider it only if at least it's NON-GMO.

    This may be a way of weeding out the deadwood, the weeds. The idiots who vote themselves into the ovens to be gassed may need to go – get sick and die. Sounds heartless. Not really. My heart is broken. But it still may be true. The wise ones will steer clear of anything other than Organic and home grown (I hope the FDA does not outlaw home grown food!). Tragic but maybe that is what is going on in the big picture. Who is to say?

    The argument that they can not get non-gmo ingredients is false. The biggest buyer of non-gmo grain is ADM. All of it is exported. They even operate a crushing plant in Illinois that crushes only non-gmo soybeans for the export market demand for non-gmo oil and meal. ADM is in the business to make the maximum profit on each bushel of grain handled. If a domestic buyer wanted it, why would ADM not sell it to them. Another non-gmo crush is CGB at their plant on the Ohio river. Again the products are exported. There are supplies of non-gmo grains in the US, all they have to do is bid for them. I am a non-gmo farmer.

    Everyone needs to post the names of the companies who gave money to defeat I-511 on their Facebook Pages, as well as those companies who gave money to get it passed. Then do not buy any products from those companies who fought it. We, the consumers, have the power to stop GMO's in their corporate tracks. Money speaks. Do not buy their products!!

      Yes, eliminating these toxic foods will be achieved through grass-roots efforts. So we should all step up the social media blitz against GMOs until just about everyone is at least aware of it. Even more powerful is personal testimony of how removing or at least drastically reducing GMO exposure has helped improve your vitality. Experts quoting studies is one thing, but what really gets attention is when your family member, friend, co-worker, etc. tell you their positive experience. In this way the truth will be revealed for all to see regardless of how much effort the GMO proponents expend.

    If it weren't for Whole Foods, I wouldn't be able to eat. All of my food allergies prevent me from shopping elsewhere or eating out. Whole Foods is helping us be able to know what is in our foods. They should be supported completely– not boycotted!

      Mary, Surely there are other stores that sell healthful food where you are. If not, there are online sources. Whole Foods is not helping us, it is making money as best it can, not really being proactive. You cannot trust them and must be just as careful with what you buy from them as what you buy from any supermarket.

    Just boycotting buying bread.with gluten. I just finished drinking my juice which is made of ABC-apple, beets and carrots. Try it if you have stomach problem because of the wheat being modified. Bought organic chicken and eat more vegetable as you can. It does wonder to us and boycott bread anything modified

    Very hard to understand! Why people wouldn't want to know what they are eating and if there is no problem with the good why the producer would not want them to be labeled?
